Prenuptial Agreements in Chicago
Flat-Fee, Attorney-Drafted Prenups That Actually Hold Up
Why Consider a Prenup?
- Protecting a business, professional practice, or future equity compensation
- Clarifying what stays separate and what becomes marital
- Providing peace of mind around past debts or future inheritances
- Reducing conflict, cost, and uncertainty if the marriage does end
If you’re building a career, carrying significant assets or debt, or entering a second marriage, a prenup is often one of the most cost-effective planning tools you can use.

Why Not Just Use AI or Online Forms?
Illinois courts care about:
- Full and fair financial disclosure
- Voluntariness (no pressure, adequate time before the wedding)
- Fairness and lack of unconscionability
- Proper execution (signing, notarization)
AI tools and generic forms can’t:
- Give you strategic, state-specific legal advice
- Predict how Cook County judges will treat aggressive or one-sided terms
- Engineer the timing, disclosure, negotiation, and signing process so there’s a solid record if the prenup is ever challenged
We’re happy to start from a client’s AI or online draft, but our job is to stress-test it under Illinois law and turn it into an agreement we’re comfortable defending years down the road. For a deeper look at how our representation compares, see Why Choose Hunsinger Law Group Over AI or Online Prenup Services.
Our Process
Step 1: Strategy Call (20–30 minutes)
We talk through your situation, your goals, and whether you need drafting or review of an existing agreement. We’ll also discuss timing, other counsel, and fees.
Step 2: Information & Disclosure
You’ll provide financial information (assets, debts, income, business interests, equity, expected inheritances) so we can advise you on what Illinois courts will consider “full and fair” disclosure.
Step 3: Drafting & Review
We prepare a draft tailored to your facts, or we review and revise an existing draft if you bring one. We explain the major provisions in plain English and make sure you understand what you’re agreeing to.
Step 4: Negotiation & Revisions
We coordinate with your fiancé(e)’s attorney as needed, answer questions, and work through one or more rounds of revisions to get to a deal both of you can live with.
Step 5: Signing & Record
We manage timing, execution, and notarization so the agreement is signed properly and the process is well documented.

Frequently Asked Questions
It’s strongly recommended — and courts look more favorably on prenups where each party had a meaningful opportunity for independent counsel. Our standard approach is to represent one spouse and encourage the other to have their own attorney review the agreement.
How far before the wedding should we start?
Earlier is better. Ideally, you should start the process at least 2–3 months before the wedding so no one can argue they were pressured or surprised. For a step-by-step timeline, see Your Prenuptial Agreement Journey.
Can we work remotely, or do we have to come into the office?
Most of the process can be done by video and email. For signing, we’ll coordinate notarization in a way that complies with Illinois requirements and works with your schedule.
I already used an online/AI tool. Can you still help?
Yes. We often review and “upgrade” existing drafts. We’ll tell you honestly whether your current agreement is close or whether it has serious gaps under Illinois law. See our full comparison: Why Choose HLG Over AI or Online Services.
What if I live in Chicago but I’m getting married elsewhere?
We’ll talk through where you live now, where you expect to live during the marriage, and any other relevant jurisdictions, then advise you on the best governing-law and venue approach.
